| K3 Visa Information: Marriage Visa / Spousal Visa | |||||||||
| The K3 Marriage Visa is a multiple entry visa. The foreign spouse may use the K3 Visa to travel to and from the US. Upon entering the US, as soon as possible and prior to the expiration of the K3 visa, the foreign bride or husband must file for adjustment of status in order to become a permanent resident "green card" holder. In order to file for adjustment of status, the foreign bride or husband must first have received an approval notice of the spousal immigrant visa petition from the USCIS that was originally filed at the time of K3 visa processing. Expiration of K3 VisaFrom the date of issuance, the K3 visa is valid for two years on the condition that the foreign bride must apply for and obtain adjustment of status to “green card” holder as soon as possible. The K3 visa can be cancelled if immigration officials believe the foreign spouse does not want to obtain a “green card” or does not want to live in the US permanently. The two-year period may be extended as long as the foreign spouse properly
applied for a green card and
has not neglected her efforts in pursuing the green card, but for some
reason the green card has still not been issued. K4 Visa for ChildrenFrom the date of issuance, the K4 visa is also valid for two years. However, it will expire earlier if the child turns 21 years old and still has not obtained a green card. At the time the parent receives his or her green card, the child must receive one as well or else the K4 visa will expire. The two-year period may be extended as long as the child properly applied
